Terms of service

1.The agreement

These Terms of Service (“Terms”) are a contract between you and AA Funnel (“AA Funnel”, “we”, “us”) for the use of aafunnel.com, the AA Funnel application, its APIs and MCP server, and every page, member area and email delivered through them (together, the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you accept on behalf of a company or other entity, you confirm you have authority to bind it, and “you” means that entity.

2.Accounts and workspaces

• You must be at least 18 and provide accurate account details. Keep your password and API keys secret; everything done with them is your responsibility.
• A workspace is owned by the account that created it. Owners may invite team members with roles (admin, editor, viewer) and are responsible for their actions.
• Tell us promptly at the address below if you suspect unauthorised access.
• We may suspend an account that breaches these Terms, is used for fraud or abuse, or whose payment is overdue, after notice where practical.

3.Plans, trials and billing

• The Starter plan is free and limited as described on the pricing page. Paid plans (Growth, Scale) are billed monthly in advance in Indian Rupees unless another currency is shown at checkout.
• Paid plans start with a 14-day free trial. You are charged when the trial ends unless you cancel before that. No card is needed for the free plan.
• Prices exclude GST and other applicable taxes. Customers in India are charged GST at the prevailing rate and receive a tax invoice; provide your GSTIN in Settings to have it printed on invoices.
• Subscriptions renew automatically until cancelled. Cancel any time from Settings → Billing; the plan stays active until the end of the paid period and is not renewed.
• If a renewal payment fails we retry and notify you. After 14 days without payment the workspace is downgraded to the free plan; content above the free limits is paused, not deleted.
• We may change prices with at least 30 days’ notice by email. Changes apply from your next renewal after the notice period.
• Refunds are governed by our Refund Policy, including a 30-day money-back guarantee on the first payment of a paid plan.

4.No transaction fees; your gateway, your money

AA Funnel does not charge a percentage of your sales on any plan. Payments from your customers go to the payment gateway account you connect (Razorpay, Stripe, PayPal, Cashfree, Instamojo, Paddle, Paystack, Xendit and others). Those providers charge their own fees under their own terms, and you must comply with them. We never hold your customers’ funds and are not a party to sales between you and your customers.

5.Your content and your customers’ data

• You own the funnels, pages, products, courses, emails, media and other content you create or upload, and the customer data you collect. You grant us a licence to host, copy, transmit and display it only as needed to run the Service.
• You are the data controller for your customers’ data; we process it only on your instructions as described in the Privacy Policy. You are responsible for having a lawful basis to collect it, for your own privacy notices and consent banners, and for honouring your customers’ rights.
• You are responsible for the products you sell, their delivery, their quality, your refund terms towards your buyers, and all taxes on your sales.
• You may export your funnels, contacts and orders at any time. We may remove content that violates these Terms.

6.Acceptable use

You must not use the Service to:

• Break any law, including consumer-protection, advertising, tax, securities and gambling laws, or the DPDP Act and equivalent privacy laws.
• Sell or promote illegal goods, weapons, controlled substances, counterfeit goods, or content that is sexually explicit involving minors, hateful, violent or defamatory.
• Run get-rich-quick, pyramid, multi-level or investment schemes, unlicensed financial or medical services, or make deceptive earnings or health claims.
• Send unsolicited email (spam), scrape or harvest contacts without consent, or use purchased lists. Every marketing email must carry a working unsubscribe link, which the Service adds automatically.
• Phish, impersonate any person or brand, or clone a website you have no right to reproduce with the import-from-URL feature.
• Interfere with the Service, probe or bypass its security or rate limits, or resell access without our written agreement.
• Use the AI features to generate content that violates any of the above.

We may suspend or terminate accounts that breach this section without notice where the breach is serious, and may report unlawful activity to the authorities.

7.Our intellectual property

The Service, its software, templates, block library, design and documentation belong to AA Funnel and its licensors. Templates and section designs are licensed to you for use in pages you publish through the Service; you may not repackage or resell them as templates. The AA Funnel name and logo may not be used without permission, except for the “Powered by AA Funnel” badge shown on free-plan pages.

AA Funnel is also available as source-available software for self-hosting under the licence in its repository. These Terms cover the hosted Service only.

8.Third-party services and AI

Payment gateways, email providers, connectors and AI models are provided by third parties under their own terms. We are not responsible for their availability, changes or charges. AI-generated pages and copy are suggestions; you are responsible for reviewing them and for any claims they make before you publish.

9.Availability, support and changes

• We aim for 99.9% monthly uptime; the Scale plan includes a written SLA with service credits. Scheduled maintenance is announced on the status page.
• We may add, change or retire features. If we retire a feature that materially affects paid customers we give at least 30 days’ notice.
• Support is by email and the in-app assistant. Response targets depend on plan (community, priority, dedicated onboarding).
• We keep rolling backups for up to 35 days but you should keep your own exports of critical data.

10.Termination

You may close your account at any time from Settings. We may terminate these Terms with 30 days’ notice, or immediately for a material breach, non-payment beyond the grace period, or a legal requirement. On termination your right to use the Service ends and we delete your data within 90 days, except records we must keep by law. Sections on content, liability, indemnity and governing law survive termination.

11.Disclaimer of warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that any results (leads, sales, conversion rates) will be achieved, or that AI output will be accurate.

12.Limitation of liability

To the fullest extent permitted by law, AA Funnel is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the Service, even if advised of the possibility. Our total liability for all claims in any 12-month period is limited to the amount you paid us in that period, or ₹10,000 if you paid nothing.

Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud or death or personal injury caused by negligence.

13.Indemnity

You will defend and indemnify AA Funnel against claims, losses and costs (including reasonable legal fees) arising from your content, the products you sell, your use of customers’ data, or your breach of these Terms or the law.

14.Governing law and disputes

These Terms are governed by the laws of India. Before starting formal proceedings, both sides agree to try to resolve any dispute by writing to the other and negotiating in good faith for 30 days. Disputes that remain are subject to the exclusive jurisdiction of the courts in India. Consumers in other countries keep any non-waivable rights under their local law.

15.General

• These Terms, the Privacy Policy and the Refund Policy are the whole agreement between us about the Service and replace any earlier agreement.
• If a provision is unenforceable the rest continues to apply. Our failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them to a successor of our business.
• We may update these Terms. Material changes are announced by email and on the changelog at least 14 days in advance; continued use after the effective date is acceptance.
